RE: The tariff classification of Agroxilato-K fertilizer from Spain
Dear Ms. Ruiz:
In your ruling request dated November 7, 2022, on behalf of your client, LekkerBio East Coast LLC, you requested a tariff classification ruling on Agroxilato-K fertilizer.
Your submission describes the subject product as a liquid fertilizer, containing soluble potash, intended for foliar and soil application. You indicate that this product will be used to improve fruit size during fruit production and water uptake in plants. The subject product contains 20% soluble potassium as the main constituent ingredient, which is derived from potassium hydroxide. Agroxilato-K fertilizer will be imported in 26 kg containers.
The applicable subheading for Agroxilato-K fertilizer will be 3105.90.0050, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for Mineral or chemical fertilizers containing two or three of the fertilizing elements nitrogen, phosphorus and potassium; other fertilizers; goods of this chapter in tablets or similar forms or in packages of a gross weight not exceeding 10 kg: Other: Other. The general rate of duty will be free.
